sublist without substructure

As you might have noticed in one of my previous posts I'm been improving a site and it's almost correct I just got one little problem that really needs to be fixed.
It's about the semantic menu using lists ( <ul<li> ) for navigation. At this page at the bottom you see what it's about.
Anywys the problem:
if I've got a sitestructure, and an my page I open a link in my menu it will automaticly print an <ul></ul> for the substructure even if I don't have one. And since this is a problem with styling (to have an extra <ul></ul>) I'd like the part that automaticly prints out the <ul></ul> to be changed, so that it will just print out the part for the substructure when it's really needed.
Can anybody help me with this?
