A proper 404 error for search engines (HTTP 1.1 status code)

I would need to know , if the error HTML part does really reflects the HTML header of 404 error, when a webpage is missing?

By default, I still get the footer with links, but should be a blank webpage.

Any help in getting the default 404 Apache error page and sending the visitor a proper HTTP 1.1 status code.
