To have it more clear I updated the code. The copyright information is now more neutral - "phpwcms Copyright (C) 2003-2004 Oliver Georgi. Extensions are...". I removed any link/text containing webverbund.de.

Copyright info is included in the backend too.

You are allowed to:
- change the layout of the backend for your needs
- change code as long as you publish changes, who made changes and when it was changed, you have to give access to your changes (download) to any third-party (all changes are released under GPL too)

You are NOT allowed to:
- rebrand phpwcms (just give it a different name and thinking it's a code change under GPL)
- remove any copyright information
- soften or change copyrights
- if you change the place of phpwcms logo please combine logo (can be smaller) and copyright
- it's not allowed to separate copyright info and login.php

I hope this helps to clarify my point of view. Please tell me if something is mistakable or if I'm wrong.

I have a few questions about this.
First of all, what counts as a change in the code? If I change the part of the code that outputs one of the nav tables, just to change its appearance; do I have to release that?
Also, assuming I make a major addition to the code: do I have to actually put a link on my site that says "download this code here" and put a copy of my source up? Or is it enough to post my changes in the mods section of this board? If I'm using this for a photographer's website, it doesn't make much sense to offer a software download.

Further more, am I required to make it say something like "phpwcms is copyright 2004 bla bla bla" on every page that the public will see? IE, does that actually have to be in my template? Or is the GPL notice that's automatically output as an HTML comment enough?

Thanks for making such a great product, and thanks for making it free!

Normally that's the way the GPL is working.

But - you do not pack a new product. If you change such small piece of code it's enough to post it here. You do not need to publish such code change - but the code is GPL too.

It's difficult to describe.

Hi Leute!
Muss grad mal meinen Senf zur Sache Copyright Hinweise geben.

Oliver hat jetzt klar gemacht wo er seine Hinweise gerne hätte etc.
Also hat sich jetz jeder danach zu richten. Aber warum so einen Terror machen wegen einer Copyrightzeile?

Ich mein, klar ist es dem Entwickler hoch anzurechnen solch ein System erstellt zu haben. Aber ist es nicht schon genug für den Entwickler zu wissen, das das System gefällt, es genutzt wird. Ich finde wenn man seinen Namen verbreiten will kann man das Produkt auch verkaufen. Ich finde wenn es schon kostenlos ist, sollte der Anwender auch machen können damit was er will.
Stellen wir uns vor wir säßen in der Schule. Wir malen alle Bilder und der Tischnachbar malt ab oder nimmt sich ein beispiel daran und malt ähnlich. Klar wären wir ihm ein wenig böse, doch er rechnet es uns hoch an, da wir ihm die idee lieferten.
Ich bin der Meinung man sollte freie Software auch frei publizieren! Klar ist der Name wichtig, doch will der Anwender keine Seite mit tausend verschiedenen Hinweisen. Der Anwender freut sich mehr wenn es Copyright frei ist. Dann erzählt er es weiter. Der Name kommt auch so ins Rollen.
Ich finde das man da nicht so einen krawall machen sollte nur wegen einigen Zeilen.

@Oliver: Sei doch froh das so viele Leute das System nutzen und allen anschein nach auch sehr zufrieden damit sind. Warum sich feinde machen und leute verklagen? Ich halte das für schwachsinnig.

Hm, solltest Du das wirklich fordern?

Die Software ist frei - aber eben nicht urheberrechtsfrei. Da liegt der bedeutende Unterschied. Prinzipiell kannst Du intern damit doch machen was Du willst, auch wenn es nicht statthaft ist. Die Lizenz beschränkt die schwarzen Schafe, die eben nichts zurückgeben. Alle wollen alles umsonst, na dann arbeite ich doch lieber nicht - oder bleibe auf der Arbeit glucken.

Die GPL ist eine faire Lizenz und ich bin auf ein Einkommen angewiesen. Deswegen gibt es nichts umsonst. Die Pille hier ist das Lizenzrecht, die Du schlucken musst, oder aber etwas selbst - vollkommen freies - entwickelst.

Es wird schätzungsweise 5 Minuten nach Nicht-Vorhandesein der Copyright-Zeile dauern und Du wirst ein erstes kommerzielles Produkt im Verkauf sehen.

Hi!

Also ich muss auch mal was dazu sagen. Ich selbst habe auch schon so einige Anwendungen entwicklelt und da steht auch überall mein Name drunter, selbst in der Firma in der ich arbeite.

Oliver hat Recht, es geht um die schwarzen Schafe und als Privatperson solltest Du Dich ja sicherlich nicht daran stören, ob da nun ein kleines Logo prangt oder nicht.

Es gibt aber sicherlich auch findige kleine Vix** (sorry) die PHPWCMS nehmen, umgestalten und es dann Ihren Kunden als ein selbstentwickeltes CMS verkaufen und damit sicherlich nicht wenig Kohle machen. Diese bauen dann Ihr Logo ein, benennen es wahrscheinlich noch um und schwupps .... hat man ein CMS, was man seinen Kunden als "Firmeneigene Lösung" zu Pflege von Webinhalten, verkaufen kann.

Ich finde als seriöser Firmenbesitzer sollte man dem Entwickler seinen Dank zollen und so auf Ihn aufmerksam machen wie man es sich selbst auch wünscht, oder was würdest Du sagen, wenn Du der Entwickler wärst und ich tue so, als wenn Du nicht existierst? Da würde Dir sicherlich auch die "Sinn-Frage" des Projektes kommen.

Daher Danke ich noch mal Olli und Konsorten, die dieses Projekt so weit vorantreiben und möchte persönlich nicht noch solche Kommentare lesen wie "Ist doch egal ob Du was gebastelt hast, ich nehm es mir und mach damit was ich will, kann Dir doch eigentlich egal sein, ist ja kostenlos." .

Genau, dann wird nämlich ganz schnell aus kostenlos das Kosten-los.

Ich habe erst kürzlich einen Websitenbetreiber abgemahnt, da er einfach Bildmaterial eines anderen Internetauftrittes genommen hat und sein Logo drübergesetzt hat.

Es zeigt zwar, dass man etwas "richtig" macht, wenn andere kopieren, aber es bleibt eben nicht ohne Folgen...

Und damit kann man durchaus dann auch sein Geld verdienen :-)

Wenn man Gedanken fortführt, müssten sich ja alle ihr Logo/ die Marke ihres Autos abmachen, es in nicht handelsüblichen Lackierungen anbieten und es wäre nur unter der Theke erhältlich :-)
Vielleicht boomt deshalb der Gebrauchwagenmarkt so sehr :-)

Wenn doch so viele auf Markenkult stehen, dann bitte auch bei PHPWCMS!!!
Wer z.B. Dreamweaver einsetzen will, muß zuerst in das Programm investieren und dann ständig mit dem Logo im Blick arbeiten, sogar im Code.
Da ist doch PHPWCMS eine echte Alternative!

Unterstützen statt untergraben.

I am trying to follow this in google-translate but still think I could add a few words...
  • free software & even free code does not mean that it is free of copyright.
    you could not sell you videos of last nights television in shops...because it is still owned by the owners- no one disputes this right?
  • Any direct dispute with the copyright owner regarding the copyright of any 'free' product is offensive (imho). The 'Spirit' of the law should be obeyed REGARDLESS of the 'word' of the law, particularly if you find ambiguities in the 'word' that may contradict the 'spirit'.
  • (imho) Most of the arguments regarding copyright of GPL & 'opensource' software is purely an EGO/perceived intelligence issue that is MORE about people playing 'lawyer' and showing-off that they can reasonably (and sometime un-reasonably) interpret ambiguities in the copyright to offer a defense to theft. It is LESS about actual intent to re-badge and sell anything commercially. ( This would in practice require far more knowledge in far more areas than just the ability to argue semantics.
  • dreamweaver will cost you only $400 and you don't need to abide by any copyright regarding content (afaik): a cheap price to pay for those with such a strong opinion about content/copyright issues.
  • most open-source software is also an indirect source of income to the writers. credit for the application is the proof of thier ability used to secure the contracts that pay the bills that in turn enable the open-source to be continued.

In short.. Thue rules are available to read freely, Olivers express opinions are now here to read freely. live by them or spend your time and money elsewhere! it really would be no loss to lose those that refuse to accept somethings in life are NOT automatically thiers for the taking.

Das Urteil im Streit von netfilter/iptables ./. sitecom zeigt eindeutig, dass die GPL in Deutschkand bestand hat. Das Urteil vom 19.05.2004 vor dem LG München bestätigt weiterhin die einstweilige Verfügung des OpenSource-Projektes gegen Sitecom vom 02.04.2004.

Das Gericht bestätigte die Wirksamkeit der GPL in Deutschland und stellte weiterhin fest, dass man bei OpenSource-Software nicht davon ausgehen kann, dass keine rechtswirksame Urheberschaft vorliege. Vielmehr stellte das Gericht fest, dass es nur zwei Wege gibt, um Nutzungsrechte an der OpenSource-Software zu erlangen. Hierbei wird ausdrücklich bei der Verbreitung der Software über das Internet davon ausgegangen werden kann, dass der Nutzer sich über die Linzense-Vereinbarungen im klaren ist. Nur unter dieser Vorraussetzung ist der Nutzer berechtigt, die Software zu ziehen & erhält dafür im Rahmen der GPL ein Nutzungsrecht. Sollte der Nutzer mit der GPL nicht einverstanden sein, hat er sowie so kein Nutzungsrecht.

Es wird ausdrücklich bescheinigt, dass OpenSource nicht einem Verzicht auf das Urheberrecht einhergeht und Verstöße gegen die GPL somit auch gegen das Urheberrecht in Deutschland einklagbar sind.

Alles in Allem ein wichtiges Urteil, das allen OpenSource-Entwicklern den Rücken stärkt. Ich würde jedem mal den gesamten Urteilstext empfehlen, sind 20 Seiten.

Diese Diskussion, ob man den Copyright-Hinweis entfernen sollte, kann ich absolut nicht nachvollziehen. Immerhin ist der Verweis auf den Urheber ein geringer Dank, der durchaus durch die Kostenersparnis (Lizensekosten) gedeckt wird.

Zum Abschluss:
Fähige Entwickler / User haben auch kein Problem damit die Arbeit anderer zu würdigen und fair mit ihnen umzugehen.

I think so too, because this issue is ‘discussed’ all the time without answering core questions…

I think it’s superfluous to discuss further to respect GPL in terms of not removing Copyright from backend or about people take the credit for what s.o. else has done.

But I think as quoted above, It's difficult to describe and it’s difficult to get an answer, if someone does not change original PHPWCMS source, but add functionality to it.

  • a) I do NOT pack a NEW (CMS) product, but enhance PHPWCMS with functions, which are a complete separate code and no Mod's to the original code.

    b), this additional code is 'my work', for what I get paid for.

    c), the Copyright is where it should belong and I do not get paid for passing over PHPWCMS to my customer.
Under such circumstances my code is – to my understanding – first of all my property and my work. But that’s not the whole issue!

This code is an extension to PHPWCMS and because it will not run stand alone. Under GPL rules this code now MUST be freely published *) – as I understand this discussion, even though this is ‘commissioned work’ and my/the customer expects to be the ‘owner’ of this paid work (functionality) and the only one who gain benefit out of this.

I think this is the core question to professional developers, because I really cannot see that any customer want to spread his technological advantages to public for free, bearing in mind that he paid for.

Under such provisions and constraints, a forced ‘free give away’ of commissioned work always will result in attempts such as ‘pseudo’ rebranding and neglecting GPL.


To my understanding and experience a real licensing concept may resolve this and in addition would help the author of GPL software to gain a small profit as well.

Let’s say you pay EUR 100,- for each license you ‘distribute’! Is anyone trying to tell me, that such ‘peanuts’ will stop a customer from ordering a website? If such an amount is subject to ridiculous discussions, ones should change business soon.

Would be pleased to get Oliver’s point of view.

*) Btw. I never saw any WebSite based on any CMS and GPL Software, providing links to allow to download the whole source (+ all additions and changes made) for free. Did I miss the point, or did I surf the wrong web over the years? Besides of this, I personally never would allow to anyone to read the source, because of security reasons! If I would publish a website based on any of those GPL (CMS) packages, I sure would change enough code, not to be an easy target to ‘funny guys’. For me - not - disclosing source is not a subject to GPL but a subject to security at first, and subject to 'claim for possession' by customers secondly!

Das ist in keinem Falle kontraproduktiv! Da "der Entwickler" in diese Richtung offensichtlich fertig entwickelt (oder seit 4 Jahren keine Zeit) hat, ist Deine Eingabe äusserst willkommen (sowieso und ganz besonders, wenn da "was geht") :lol:
